Shield Litigation:
Last Claims are Filed
The massive Dalkon Shield litigation continues. The number of
people injured by this defective birth control device staggering, and more than
400,000 people claimed injury by filing claims in the bankruptcy court. The
deadline for filing all claims was June 30, 1994, therefore anyone injured who
has not filed claims by that date is barred.
There are still many people injured by the Dalkon Shield who have not resolved
their claims. Our best estimate is approximately 80,000 people. This number
includes approximately 10,000 victims who have rejected offers from the Trust
to settle their claim.
Dalkon Shield victims who receive an offer to settle their
case, but refuse the offer, can proceed to trial or arbitration to prove their
injuries. However, it will take many years before all of the trials and
arbitrations end. All Dalkon Shield victims represented by Brown & Szaller
should have their claims resolved in the next few years, but the Trust is
"open" until the year 2007, and it is possible that litigation
involving other victims will go on until that time.
When the bankruptcy finally ends, and the Trust closes its
doors (at the latest by the year 2007), there most probably will be
money remaining in the Trust Fund. Any monies remaining will be distributed to
Dalkon Shield victims through their attorneys. If we represented you in your
