Brown & Szaller Wins in Ohio Supreme Court

In September of last year Jim Szaller argued a very important case in the Ohio Supreme Court on behalf of a number of law firms, the Ohio Academy of Trial Lawyers, and all women in Ohio injured by the Dalkon Shield IUD.

The decision decided by the Ohio Supreme Court, Hyde vs. Reynoldsville Casket Co., protected the rights of women who had Dalkon Shield IUD's inserted in them in the state of Ohio. Before the Ohio Supreme Court decided Hyde it was unclear whether those Ohio women would have their claims barred in Ohio courts because of the statute of limitations. However, the Hyde decision now protects their rights.

Now, if a woman had a Dalkon Shield inserted in the state of Ohio, the Ohio victim can sue the manufacturer of the IUD, and probably will not be barred by the applicable Ohio statute of limitations.
